ChromVale Scientific warrants that, at the time of delivery, products supplied by ChromVale will materially conform to the applicable product description and any express written specifications identified in the accepted order, quotation, or order confirmation.
Where a manufacturer provides an applicable product warranty, ChromVale may assist the Customer in obtaining the benefit of that warranty and may require compliance with the manufacturer’s warranty procedures, documentation requirements, inspection process, or technical evaluation.
Unless expressly stated otherwise in writing, ChromVale does not provide any warranty that a product will achieve a particular analytical result, separation, resolution, retention time, efficiency, pressure profile, sensitivity, recovery, lifetime, or suitability for a specific method or application.
A product will not be considered defective solely because its analytical performance differs from a prior column, competing product, reference chromatogram, published application, or Customer expectation where the product otherwise conforms to its applicable specifications.
Warranty coverage does not apply to damage, degradation, contamination, or performance issues resulting from improper installation, misuse, incompatible solvents or samples, operation outside stated specifications, excessive pressure, improper storage, inadequate sample preparation, instrument malfunction, unauthorized modification, normal wear, or other conditions outside ChromVale’s reasonable control.
For chromatography columns and other consumable analytical products, product lifetime may depend significantly on the sample matrix, method conditions, mobile phase, pressure, temperature, handling, cleaning practices, and instrument condition. Accordingly, ChromVale does not warrant any minimum service life or injection count unless expressly stated in writing.
The Customer must notify ChromVale within a reasonable period after discovering a suspected defect and must provide sufficient information to permit investigation, including, where applicable, the product part number, lot number, serial number, order details, photographs, chromatograms, method conditions, system pressure, mobile-phase composition, sample information, and relevant handling history.
ChromVale may require the affected product to be returned for inspection or may consult the manufacturer or supplier before determining whether a warranty claim is valid.
If a product is confirmed to have a covered defect, the applicable remedy will be determined in accordance with the Exclusive Remedies section of these Terms and may include replacement, credit, or refund, as appropriate.
Except for warranties expressly provided in writing by ChromVale and to the maximum extent permitted by applicable law, no other express or implied warranty is created by product descriptions, technical assistance, manufacturer data, sample chromatograms, recommendations, or other communications.
Nothing in this section excludes or limits any warranty or other right that cannot lawfully be excluded or limited under applicable law.
